That matters because minor-source permitting is now the standard route for behind-the-meter power at AI facilities. xAI and Meta have both used it to build gas plants attached to their data centers, bypassing the grid and the longer major-source review that would come with a larger declared emissions footprint. If states scale back notice requirements, communities near those sites may have no window to learn a plant is coming until it is under construction.

An EPA spokesperson said the proposal "would put state and local agencies most familiar with local issues in the driver's seat to determine whether, when, and for how long to provide opportunities for public participation for proposed new minor sources and modifications," and noted the rule would not alter emissions standards themselves. State variation is already stark. "Who knows [if] the next administration, whether they would actually change it," Gary said.

Texas is the counterexample. The state's data center boom has driven a large private gas plant buildout, most of it permitted as minor sources. State enforcement is lighter, and some communities have only learned the scope of the fossil fuel infrastructure being installed near their homes after construction was well underway. That pattern is the one other states could adopt if the rule is finalized.
Powell said the timing is not incidental. Public opposition has become a real drag on data center schedules, with permit challenges and local hearings extending timelines that operators had counted on being fast. The EPA spokesperson framed the agency's broader work as making the US "the AI capital of the world."

Vanessa Lynch, a Pennsylvania organizer with Moms Clean Air Force, told the hearing that communities hosting data centers consistently want more information, not less. Sara Lips, director of communications at Georgia's Environmental Protection Division, said the agency is still "determining whether proposed federal rule changes would affect the public participation requirements per the state regulations." No final rule has been issued.
For AI operators, the change would remove one of the few remaining friction points in siting behind-the-meter power. Grid interconnection queues stretch years in many regions, which is why gas plants tied directly to a data center have become the fastest way to bring new AI capacity online. Anything that shortens the permit timeline for those plants — even by weeks — compounds across a build schedule measured in gigawatts.
The rule is one of several federal moves reshaping the economics of the data center buildout. It sits alongside broader EPA and Department of Energy efforts to accelerate permitting for AI infrastructure, and it lands in a market where hyperscalers are announcing multi-billion-dollar campuses on quarterly cadence. The question the rule surfaces is not whether AI compute gets built — it will — but who gets to see the plans before construction begins, and whether that visibility is worth the days or weeks it adds to a schedule. For companies burning cash to catch demand, the answer is already clear; for the neighbors, the answer will now depend on which state they live in.
