The turbine count has climbed sharply over twelve months. xAI had 35 turbines on site in May 2025, and the Greater Memphis Chamber of Commerce said at the time that only 'about half' would remain once the facility stabilized. Instead, the company added more, reaching 46 in operation according to local reporting.
The legal dispute hinges on what counts as stationary. The Southern Environmental Law Center argues that federal law treats trailer-mounted generators as stationary sources when they remain in one location and feed a fixed facility, making them subject to Clean Air Act permitting. This follows xAI's earlier expansion at its Colossus 2 site, where the company added 19 gas turbines as the NAACP suit was already underway. The Mississippi buildout sits inside the same regional power and water footprint that xAI has been using to scale Grok training and inference. Gas turbines have become the company's preferred bridge while utility-scale grid connections lag behind compute demand.
The 15 permitted turbines went through the standard air-quality review process, which includes emissions modeling for nitrogen oxides, volatile organic compounds, and particulate matter. The 31 unpermitted units have not been subjected to that public review. The Southern Environmental Law Center says the cumulative emissions from running 46 units simultaneously materially change the air-quality picture for surrounding neighborhoods.
xAI's siting strategy has favored speed over the typical multi-year utility interconnection timeline. Behind-the-meter natural gas generation lets the company bring compute online in months rather than years, and the 'mobile' designation compresses the regulatory path further. Competitors building at similar scale have generally pursued grid power, on-site solar, or, more recently, geothermal power purchase agreements.
Elon Musk has publicly defended the Mississippi and Memphis buildouts as necessary to keep xAI competitive on training compute. The company has not disclosed the combined nameplate capacity of the 46 turbines or the share of the data center's load they serve. Local utility filings would typically capture that figure, but the mobile classification has kept much of it outside the standard disclosure regime.
The case will turn on whether the court accepts the federal-law argument that flatbed mounting does not, by itself, make a power source mobile. A ruling for the NAACP would force xAI to either apply for stationary-source permits on the remaining 31 turbines or take them offline. xAI has not yet filed its response to the injunction motion.
The Mississippi fight is becoming a template for how the AI buildout collides with environmental permitting. Behind-the-meter gas is the fastest way to get megawatts to a GPU cluster, and trailer-mounted turbines are the fastest version of that. If the mobile loophole holds, expect more frontier labs to copy the playbook; if it breaks, xAI's compute roadmap, and the industry's improvised power strategy, both get more expensive and slower.
